3.Our Role as Consultants
Our role is to provide professional advice, prepare documentation, schedule appointments, and submit applications on your behalf. We will use our expertise and best efforts to maximise the prospects of a successful application, but we cannot guarantee any particular outcome.
Visa rules, fees, processing times, and eligibility criteria are set by the destination country and may change without notice. We will keep you informed of any changes that come to our attention, but the ultimate responsibility for meeting all eligibility requirements rests with the applicant.
4.Client Obligations
When you engage our services, you agree to the following obligations:
- Provide complete, accurate, and truthful information at all times
- Submit all documents requested by us within the timelines we specify
- Disclose all prior visa applications, refusals, deportations, criminal records, and adverse immigration history
- Pay all fees (consultancy fees, embassy fees, third-party fees) as agreed and within stipulated timelines
- Attend all interviews, biometric appointments, medical examinations, and other appointments arranged on your behalf
- Comply with the laws of India and the destination country at all times
- Promptly inform us of any change in your circumstances (employment, marital status, residence, contact details) that may affect your application
We reserve the right to terminate any engagement where we discover that information provided to us was false, misleading, or incomplete. In such cases, fees paid will not be refunded.
5.Fees and Payment
Our service fees are quoted in writing before the engagement begins and form part of your agreement with us. Fees are categorised as follows:
- Consultancy / professional fees payable to MVTS India for our services. These cover advisory, document preparation, and submission services.
- Statutory and embassy fees payable to the destination country. These are passed through to the relevant authority and are generally non-refundable.
- Third-party fees for VFS, BLS, TLScontact, IELTS, medical tests, document attestation, courier, and similar charges.
- Travel costs for air tickets, hotels, tours, and ground transport.
Payment is to be made in Indian Rupees, except where a foreign-currency payment is unavoidable (for example, embassy fees payable abroad). We accept payment by cash, cheque, demand draft, NEFT/RTGS/IMPS, UPI, and major credit/debit cards through our payment gateway.
An official receipt or tax invoice is issued for every payment received. GST will be charged in addition to our consultancy fees at the rate prevailing on the date of invoice.
6.Processing Times
Visa processing times depend entirely on the destination country and the category of visa applied for. Indicative timelines we may share are based on past experience and are not a guarantee. The applicant accepts that processing may be delayed for reasons including but not limited to:
- High application volumes at the embassy or consulate
- Additional document requests, interviews, or background checks
- Strikes, public holidays, force majeure events, and policy changes
- Delays caused by the applicant in providing documents or attending appointments
MVTS India is not liable for any loss, damage, or expense arising from such delays.
7.Travel Services and Bookings
For air tickets, tour packages, MICE services, and hotel bookings, the terms and conditions of the underlying supplier (airline, hotel, tour operator, conference venue) apply in addition to these Terms.
It is the responsibility of the traveller to ensure that:
- Their passport is valid for at least six months beyond the date of return
- They hold all required visas, transit visas, and onward travel documents
- They comply with health requirements (vaccinations, COVID-19 protocols, yellow fever) of the destination
- They reach the airport, station, or pick-up point well in advance of the departure time
MVTS India is not responsible for missed flights, denied boarding, or refused entry caused by the traveller's failure to meet these requirements.
8.Non-Refundable Policy
All fees and amounts paid to MVTS India are strictly non-refundable. The full terms of our non-refundable policy are set out in our No Refund Policy, which forms an integral part of these Terms. Clients are required to read and accept that policy before making any payment.
9.Limitation of Liability
To the maximum extent permitted by law:
- Our total aggregate liability under any engagement shall not exceed the consultancy fees paid by you to MVTS India under that specific engagement.
- We shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, business, or opportunity.
- We shall not be liable for any visa refusal, application processing delay, change in immigration policy, or act of any embassy, consulate, or immigration authority.
- We shall not be liable for the acts or omissions of third-party suppliers (airlines, hotels, tour operators, insurance companies) even where bookings are facilitated through us.
10.Force Majeure
MVTS India shall not be liable for any failure or delay in performing its obligations where the failure is caused by circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, government action, pandemic, embassy closures, strikes, or natural disasters.
